Bankruptcy will stop garnishments, repossessions and lawsuits.
If you can file a Chapter 13 bankruptcy, unsecured debts can sometimes be paid less than 100% depending on the circumstances in your case. Car loan payments can be reduced and past due home loan payments can be repaid over time.
If you can file a Chapter 7 bankruptcy, you can get rid of some or all unsecured debts, can surrender items that are secured such as autos and avoid liens on pledged household goods and keep the household goods.
Stop Foreclosures

If you wait until after the date of the foreclosure sale, it will be too late. The filing of a bankruptcy cannot undo a foreclosure sale.
If you want to keep the home and can file a Chapter 13, then your regular monthly mortgage payments will be paid each month by the Chapter 13 Trustee with money you will get to the Trustee by either direct payments from you or a wage deduction. In addition, a certain amount will be paid each month on what you are behind so that at the end of the Chapter 13, your mortgage payments will be current.
If you cannot keep the home for any reason, you can discuss with the attorney the filing of a Chapter 7 bankruptcy to stop the foreclosure and give you some temporary protection while you make plans to move.
Stop Repossessions
If you are behind on your car or truck payments and the creditor is threatening to pick up the vehicle or has already picked it up, you need to call our office at 865-588-5111 so we can quickly get you in to our office to speak with an attorney at a free appointment to see about filing a Chapter 13 or Chapter 7 bankruptcy.
If you file a Chapter 13 bankruptcy, the payments would be paid by the Trustee each month with money you will get to the Trustee by direct payments from you or a wage deduction. If the creditor has already repossessed the vehicle, if you have full coverage insurance and file a Chapter 13 bankruptcy in most cases we can get the vehicle back but your case would have to be filed before the creditor sells the vehicle.
If you do not want to keep the vehicle or get the vehicle back, you can talk to the attorney about filing a Chapter 7 bankruptcy to surrender the vehicle and then not be obligated to pay for any deficiency balance you will owe after the vehicle sells.

Resolve Tax Debts
Recent income taxes are not discharged but general income taxes more than three years old or older can be discharged in bankruptcy. For recent taxes, they can be paid in small payments and you will have protection from IRS collection in a Chapter 13 payment plan.
